However, the Court noted that practically, clients struggle to find any remedy when a lawyer fails them. If the BCI and State Bar Councils do not act swiftly on complaints, the client is left in a "remedy-less" situation. The Court emphasized that regulatory bodies should be “two steps ahead” of misconduct to ensure that the rest of the profession can thrive and maintain public trust.

Responding to the Court's queries, the counsel representing the Bar Council of India explained that the disciplinary mechanism is governed by the Advocates Act. Under the current rules, a State Bar Council has one year to decide on a complaint. If they fail to do so, the matter is automatically transferred to the BCI.

Despite this, the Bench remained unsatisfied with the "theoretical" efficiency of the law, pushing for "practical" data on how many complaints are actually resolved and how long it takes for a client to see justice.

The Supreme Court did not mince words regarding the public’s view of the legal field. The Bench noted a growing perception that professional standards have declined. The Court clarified that its intent was not to tarnish the profession but to protect it.

"There is a general perception that this profession has gone down," the Court remarked. "Reason being that if there are black sheep, have you dealt with them immediately? It is intended to protect the profession, not to tarnish it."

In a significant directive, the Supreme Court asked the BCI to convey to its Chairman and office-bearers the need for an "impact assessment" of their functioning. The Court wants to know if the existing professional bodies are capable of immediately taking up and dealing with complaints of professional lapse.

Additional Solicitor General Archana Pathak Dave also contributed to the discussion, noting that while bodies like banks should not unilaterally blacklist lawyers through "caution lists" (as they are not experts in law), the BCI must step up so that such external actions become unnecessary.

The Supreme Court’s scrutiny serves as a wake-up call for the Bar Council of India and all State Bar Councils. By emphasizing that the legal profession’s "nobility" depends on its ability to self-correct, the Court has placed the ball firmly in the BCI's court.

For the legal system to remain credible, the disciplinary mechanism must move beyond procedural technicalities and deliver real, timely justice to clients who have been wronged by the very people meant to protect their legal rights.
