The Allahabad High Court has clarified a crucial rule regarding legal practice in India, holding that advocates who do not clear the All India Bar Examination (AIBE) within two years of their provisional enrolment are not entitled to continue practicing law. The court emphasized that provisional enrolment is strictly time-bound and does not give a lawyer an indefinite right to appear before courts.

The ruling came during the hearing of a petition filed by an advocate whose provisional enrolment had lapsed. The petitioner sought permission to continue practicing despite failing to clear the mandatory bar examination within the stipulated two-year window. Rejecting the plea, the High Court underlined that clearing the AIBE is a statutory requirement designed to maintain professional standards across the legal fraternity.

Under the rules framed by the Bar Council of India (BCI), law graduates who enroll with a State Bar Council receive a provisional enrolment certificate. This temporary status allows them to practice law for a maximum period of two years. Within this frame, candidates must appear for and clear the AIBE to secure a permanent Certificate of Practice.

The High Court observed that allowing advocates to practice beyond the two-year period without passing the exam directly violates the Bar Council of India Rules. The judges noted that the two-year timeline is generous enough for any law graduate to attempt and clear the national examination, which tests basic legal knowledge and advocacy aptitude.

Addressing arguments regarding hardship, the bench made it clear that procedural conditions set by regulatory bodies like the BCI cannot be bypassed. The court stated that the primary objective of the AIBE is to ensure that only qualified individuals represent litigants in court, thereby safeguarding public interest and the integrity of the judicial system.

Consequently, if an advocate fails to clear the exam within the permitted two-year period, their right to practice automatically comes to an end. They cannot file appearances, plead cases, or act on behalf of clients until they successfully clear the AIBE and obtain a valid Certificate of Practice from the Bar Council.

This decision serves as a firm reminder to newly enrolled law graduates across the country. Provisional enrolment is merely a temporary bridge to full-fledged legal practice, and clearing the All India Bar Examination within the two-year deadline remains a non-negotiable requirement for every practicing lawyer.
