New Delhi: In a significant legal development just ahead of today’s crucial hearing, West Bengal Chief Minister Mamata Banerjee has moved an urgent interlocutory application before the Supreme Court. The Chief Minister is seeking immediate directions to halt the deletion of voters from the state's electoral rolls, flagging a massive threat of "large-scale disenfranchisement" under the ongoing Special Intensive Revision (SIR) process.

The application comes at a time when the state is witnessing a high-stakes legal battle over the integrity of its voter lists. Banerjee, who is set to appear in person before the top court today, has alleged that the Election Commission of India (ECI) has shifted its stance on mandatory hearings, putting the voting rights of lakhs of citizens at risk.

The core of the dispute lies in the classification of voters under the "Logical Discrepancy" and "Unmapped" categories. According to the Chief Minister’s application, over 60 lakh hearings are still pending, with the final electoral roll deadline of February 14 looming large. With barely four days left for officials to complete these hearings, the application argues that a fair process is effectively impossible.

Banerjee highlighted that on January 19, the ECI had reportedly assured the Supreme Court that cases involving simple name mismatches would not require mandatory physical hearings. However, she alleges that the poll body subsequently issued circulars making these hearings compulsory, even for minor spelling variations.

"Thousands of cases were reclassified as 'Logical Discrepancy' without disclosing specific reasons or a clear hearing schedule," the application states. The Chief Minister contends that these categories—which include cases where age gaps between family members appear "illogical" to an algorithm—now account for more than 50 percent of the flagged cases, involving roughly 70 lakh voters.

Key Directions Sought by the Chief Minister

In her prayer to the Supreme Court, Mamata Banerjee has sought several urgent interventions:

No Deletions for Mapped Voters: She has urged the Court to ensure that no voter already "mapped" with the 2002 electoral roll is deleted. While discrepancies can be rectified, the Chief Minister insists that no such voter should be disenfranchised.
Withdrawal of Mandatory Hearings: The plea asks for the withdrawal of mandatory hearings for minor discrepancies like spelling variations. Instead, she suggests these should be corrected suo moto (on their own motion) by officials using existing records or Aadhaar data.
Removal of Micro Observers: A significant portion of the plea targets "Micro Observers." Banerjee has asked for their withdrawal, alleging they were appointed without statutory (legal) authority and are interfering with the duties of Electoral Registration Officers (EROs).
Acceptance of State Documents: The application requests that documents issued by state authorities—such as Panchayat Residence Certificates, Family Registers, and Socio-Economic Caste Census data—be accepted as valid proof, rather than insisting on a narrow set of documents.
Formal Communication Channels: The Chief Minister has criticized the use of informal channels like WhatsApp for official election instructions, praying that all procedures be communicated through formal, official channels to ensure accountability.

The Chief Minister argues that unless the Supreme Court intervenes immediately, genuine voters face the risk of being stripped of their primary democratic right just before the final rolls are published. The application suggests that the current pace and method of the SIR exercise are "irreversibly prejudicing" electors and could undermine the conduct of free and fair elections in West Bengal.
