The Basis of the CBFC’s Demands

The CBFC, which operates under the framework of the Cinematograph Act, 1952, proposed six specific alterations to the film before granting certification. While the full list of modifications is subject to the court proceedings, two directions stand out for their cultural and political sensitivity:

1.Deletion of the Beef Biryani Scene: The CBFC demanded the removal of a scene depicting the consumption of beef biryani.
2.Removal of the Burqa Song Sequence: The board sought to eliminate a song sequence that features the lead actress wearing a burqa.

The producer’s decision to move to the High Court signals a clear contention that these specific cuts are dictated by extraneous factors and are not justifiable under the guidelines meant to protect public order, decency, or morality.

The Constitutional Challenge

At the heart of the producer's argument is the fundamental right to Freedom of Speech and Expression, guaranteed under Article 19(1)(a)of the Indian Constitution. Judicial precedents, including landmark Supreme Court rulings, have established that films, as a medium of communication, fall squarely within the protection of this right.

The petition contends that:

Arbitrary Intervention: The demand to delete scenes based purely on cultural or dietary content (like beef consumption, which is legally permitted and culturally common in Kerala) constitutes arbitrary interference with artistic choice.

Discrimination and Over-Censorship: Censoring a widely accepted religious garment (the burqa) in a song sequence is argued to be an unnecessary restriction on creative expression and potentially discriminatory, raising questions about the board's adherence to neutrality.

The legal strategy focuses on compelling the High Court to scrutinize the rationale behind these cuts and declare whether the CBFC is acting as a censor—imposing subjective moral standards—rather than a certifying body—ensuring compliance with statutory guidelines.
