New Delhi: In a significant move to protect the personal liberty of citizens, the Supreme Court of India has once again sent a stern message to the lower judiciary: the grant of bail should not be made conditional upon the deposit of money. Reiterating a long-standing legal principle, the Court emphasized that "Bail is the rule, and jail is an exception," and turning bail into a financial transaction undermines the very essence of justice.

The ruling comes at a time when legal experts and activists have been raising concerns over "onerous" bail conditions that effectively keep poor and middle-class undertrials behind bars, even after they have been granted bail on paper.

The matter reached the Apex Court after a petitioner challenged a High Court order that had granted bail but imposed a heavy financial burden as a pre-condition. In many such cases across India, Trial Courts and High Courts often direct accused persons to deposit a portion of the "alleged" cheated amount or a fixed cash security before they can walk free.

While courts often do this to "secure the interests of the victim," the Supreme Court has consistently held that criminal courts are not recovery agents. The primary purpose of bail is to ensure that the accused attends the trial, not to recover money for the complainant before the guilt is even proven.

A bench of the Supreme Court, while hearing the matter, observed that imposing such financial conditions often amounts to a denial of bail itself. If an accused person does not have the financial means to deposit the required amount, the bail order becomes a "meaningless piece of paper."

The Court reiterated the principles laid down in several landmark judgments, including Moti Ram v. State of MP, where Justice Krishna Iyer famously remarked that the "heavy price of a bail bond" often keeps the poor in jail.

Frequently, lower courts feel that by asking for a deposit, they are doing justice to the victim of a financial fraud. However, the Supreme Court has made it clear that "Victim Compensation" is a separate legal process that usually follows a conviction or specific statutory provisions, and it should not be mixed with the fundamental right to liberty.

Legal professionals suggest that this ruling will lead to a surge in "Modification of Bail" applications, where accused persons currently stuck in jail due to financial conditions can now approach higher courts to have those conditions waived or relaxed.

The Supreme Court’s stance is a victory for the rule of law. It reinforces the idea that the judiciary exists to protect the rights of the individual against the arbitrary power of the state. Liberty is a precious commodity, and the courts must ensure it is never traded for a deposit slip.
