Supreme Court Upholds Delhi High Court Order on Production of Hotel and Call Records in Adultery Proceedings

The Supreme Court of India, comprising Justices Manmohan and K Vinod Chandran, upheld the judgment delivered by the Delhi High Court on 10 May 2023. The High Court had dismissed a husband’s challenge to a family court direction requiring him to produce hotel reservation documents and call detail records (CDRs) of two mobile numbers linked to him. The direction was sought by his wife, who alleged cruelty and adultery, claiming that he had stayed at a Jaipur hotel with another woman and her daughter.

The Bench observed that the right to privacy, while recognised as a fundamental right under Article 21, is not absolute. It noted that the right may be subjected to reasonable restrictions when required in the larger public interest. The Court relied on the Delhi High Court’s reasoning that the Hindu Marriage Act expressly treats adultery as a ground for divorce. Consequently, protecting a married individual who is alleged to have engaged in extramarital sexual relations under the guise of privacy would be contrary to public interest.

The wife’s petition contended that the husband’s stay at the Jaipur hotel with another woman constituted direct evidence of adultery. She argued that the hotel’s booking registers, payment details, and identity particulars of the occupants would establish whether he had occupied the same room with a woman other than his wife. Similarly, the call detail records would reveal the frequency and duration of telephonic communication between the husband and the alleged paramour, thereby corroborating her allegations.

The husband opposed the production of these documents on two grounds. First, he asserted that disclosure would violate his own right to privacy. Second, he argued that revealing the records would impinge on the privacy of the other woman and could raise questions about the legitimacy and paternity of her minor daughter. He further submitted that the family court’s order amounted to a roving or fishing inquiry, lacking a specific nexus to the allegations.

The Delhi High Court, presided over by former Justice Rekha Palli, rejected these contentions. It held that direct proof of adultery is seldom available in matrimonial disputes, and courts often have to depend on circumstantial evidence. The Court emphasized that the wife’s request was confined to records pertaining to her legally wedded husband, whom she had reason to believe was staying with a particular woman in a specific room. It clarified that the inquiry was not aimed at gathering information about any unknown individual staying at the hotel.

Justice Palli further observed that when a spouse approaches the court for assistance in obtaining evidence that could substantiate a claim of adultery, the court ought to facilitate the procurement of such material. The High Court also placed reliance on Section 14 of the Family Courts Act, which empowers family courts to admit evidence that may not be strictly admissible under the Indian Evidence Act, provided it is relevant to the matter before the court.

The Supreme Court, in affirming the High Court’s view, reiterated that the production of hotel booking records and call detail records in the present context does not amount to an unreasonable invasion of privacy. It stressed that the limitation placed on the husband’s privacy interest is justified by the need to determine a substantive ground for divorce recognised by statute. The Bench concluded that the family court’s direction was lawful and that the husband’s challenge lacked merit.

The ruling clarifies the scope of privacy protections in matrimonial proceedings where adultery is alleged. It signals that courts may compel the disclosure of specific, targeted records—such as hotel reservations and telecommunication logs—when such material is necessary to establish a factual basis for a divorce claim under the Hindu Marriage Act. The decision reinforces the principle that statutory rights, including the right to seek dissolution of marriage on the ground of adultery, may prevail over a generalized claim of privacy when the evidence sought is directly linked to the allegation and is not overly broad.
