In a significant development following the 2026 West Bengal Assembly Election results, a Public Interest Litigation (PIL) has been moved before the Calcutta High Court. The petition seeks urgent judicial intervention and action against police officials who were allegedly present during a "bulldozer demolition" and acts of vandalism near the historic Hogg Market (New Market) area in Central Kolkata.

The plea highlights a worrying trend of post-poll unrest and specifically targets the alleged inaction of law enforcement during the destruction of hawker stalls and temporary structures.

The atmosphere in West Bengal, which has historically been charged during election seasons, saw a spike in tension following the declaration of the 2026 Assembly election results. According to the petition, on the night the results were announced, a group of individuals carrying political flags descended upon the New Market area one of Kolkata’s most iconic and busiest commercial hubs.

The petitioner alleges that these individuals used bulldozers to raze temporary structures and roadside stalls belonging to local hawkers. Furthermore, reports indicate that a political party office in the vicinity was also targeted and vandalized during the rampage.

The core of the legal challenge lies in the alleged "silent Spectatorship" of the police. The PIL claims that while the "bulldozer rampage" was carried out, personnel from the local police stations and even central paramilitary forces were present in the area. Despite their presence, the petition argues, no effective steps were taken to prevent the demolition or protect the livelihoods of the marginalized hawkers.

The plea was mentioned before a Division Bench comprising Justice Arijit Banerjee and Justice Rai Chattopadhyay. Recognizing the gravity of the allegations involving the destruction of property and the potential failure of the state machinery, the Bench permitted the formal filing of the matter.

The petitioner has approached the High Court with several specific prayers aimed at ensuring accountability and preventing further escalation:

Inquiry Against Officers: The plea seeks a high-level inquiry into the conduct of the police officers who were on duty at the New Market area during the incident. It calls for disciplinary action against those found guilty of dereliction of duty.
Protection of Livelihood: Given that the demolished structures belonged to hawkers, the petition emphasizes the violation of the right to livelihood under Article 21 of the Constitution.
Wider Intervention on Post-Poll Violence: Beyond the Hogg Market incident, the PIL urges the Court to take cognisance of similar reports of violence, arson, and attacks on political offices across the state of West Bengal.
Preservation of CCTV Footage: To ensure evidence is not tampered with, there is an implicit demand for the preservation of all surveillance footage from the New Market area from the night of the incident.

In recent years, the term "bulldozer justice" has become a flashpoint in Indian legal discourse, usually associated with state-led demolitions of alleged illegal structures. This is not the only petition regarding post-poll unrest currently facing the Calcutta High Court. Another plea has been filed by the Aam Janata Unnayan Party, led by Humayun Kabir, which alleges large-scale violence in the Murshidabad district.

The High Court is now faced with the task of monitoring the state's law and order situation to ensure that the democratic process of elections does not result in a cycle of retribution and property destruction.

Under Indian jurisprudence, the state has a "positive obligation" to protect the life and property of its citizens. The Supreme Court of India, in various judgments, has held that the police cannot remain passive onlookers when public property is being destroyed or when the rights of citizens are being trampled upon by mobs.

In the context of West Bengal, the Calcutta High Court has previously taken a very strict stand on post-poll violence. Following the 2021 elections, the Court had ordered a CBI probe into cases of murder and rape, and a SIT probe into other cases of violence. This current PIL sets the stage for a similar judicial scrutiny of the 2026 post-poll scenario.

As the Division Bench prepares to hear the matter formally, the eyes of the legal fraternity and the public are on the State Government’s response. The Court will likely ask the State to file a report on the incidents mentioned in the PIL and explain why the police were unable to prevent the use of heavy machinery like bulldozers in a crowded market area.
