In a significant judgment reinforcing the principles of criminal jurisprudence, the Supreme Court of India has ruled that the failure of the police to recover the weapon used in a murder does not automatically weaken the prosecution's case. The Court emphasized that if the testimony of eyewitnesses is reliable and consistent, a conviction can be upheld even in the absence of the physical weapon of assault.

The Bench comprising Justice J.K. Maheshwari and Justice Atul S. Chandurkar passed this observation while dismissing an appeal filed by convicts who challenged their life imprisonment sentence.

The case dates back to a violent incident triggered by a dispute over the grazing of crops. According to the prosecution, the accused persons launched a daylight attack on the victims. The deceased were allegedly dragged out of their house and brutally assaulted with sharp-edged weapons and firearms.

Four eyewitnesses—all of whom were related to the deceased—testified in court. They provided a vivid and consistent account of how the accused repeatedly attacked the victims until they died on the spot.

Based on this evidence, the Trial Court (Sessions Court) convicted the accused under Section 302 (Murder) read with Section 34 (Common Intention) of the Indian Penal Code (IPC). This conviction was later upheld by the Jharkhand High Court, leading the appellants to approach the Supreme Court.

The primary contention raised by the appellants before the Supreme Court was the "missing link" in the investigation. They argued that despite the allegations of using swords, axes, garasas, and firearms, the Investigating Officer (IO) failed to recover a single weapon of offence.

The defense argued that:

The absence of the murder weapon creates a "serious doubt" about the entire prosecution story.
Without the physical weapon, it is difficult to scientifically link the injuries to the accused.
Lapses in investigation should result in the "benefit of doubt" being given to the accused.

The Supreme Court rejected these arguments, clarifying that criminal trials are based on the "totality of evidence" rather than a single technicality like the recovery of a weapon.

1. Recovery is not a 'Sine Qua Non' The Court held that the recovery of the weapon is not a sine qua non (an essential condition) for conviction. While recovery helps strengthen a case, its absence is not "fatal"—meaning it cannot kill the prosecution's case if other strong evidence exists.

2. Primacy of Eyewitness Testimony The Bench noted that in this case, there were four eyewitnesses whose statements remained consistent throughout the trial. The Court observed:

"The absence of recovery of the weapons of assault would not weaken the case of the prosecution in the presence of other evidence on record that is found reliable."

The Court further explained that when the version of eyewitnesses regarding the assault is found trustworthy and is supported by medical reports (showing that the injuries were consistent with the alleged weapons), the failure of the police to find the weapons becomes secondary.

3. Investigation Lapses vs. Justice Relying on previous precedents like Rakesh v. State of Uttar Pradesh (2021), the Court reiterated that the mistakes or negligence of an Investigating Officer (IO) should not allow a criminal to escape justice. If the court finds the evidence of witnesses to be "sterling" (of high quality), the accused cannot take advantage of a poor investigation.

This ruling is crucial for the Indian legal system for several reasons:

Prevents Technical Acquittals: Often, accused persons are acquitted simply because the police failed to find a knife or a gun, even when dozens of people saw the crime happen. This judgment ensures that justice is not held hostage by technicalities.
Trust in Witnesses: It empowers the testimony of victims and eyewitnesses, acknowledging that human memory and credibility can be as powerful as physical evidence.
Accountability for Crime: It sends a message that even if a criminal manages to hide or destroy the weapon, they can still be convicted if the remaining evidence proves their guilt beyond a reasonable doubt.

Upholding the concurrent findings of the lower courts, the Supreme Court dismissed the appeal and confirmed the conviction of the appellants. The Court concluded that the ocular (eyewitness) evidence in this case was "reliable, consistent, and trustworthy," which more than compensated for the non-recovery of the murder weapons.
