The Madurai Bench of the Madras High Court has quashed criminal proceedings against BJP IT Cell Head Amit Malviya, bringing a judicial halt to the controversy surrounding his comments on the 'Sanatana Dharma' row. The Court held that Malviya’s remarks—interpreting Tamil Nadu Minister Udhayanidhi Stalin’s call for the "eradication" of Sanatana Dharma as a call for "genocide"—did not amount to hate speech. In a scathing judgment, the Single Judge Bench of Justice S. Srimathy observed that the legal machinery cannot be used to target those who merely "react" to provocative statements while the original speakers face no consequences.

The Controversy The case stemmed from the "Sanatana Abolition Conference" held in September 2023, where Udhayanidhi Stalin compared Sanatana Dharma to "dengue and malaria," advocating for its eradication. Amit Malviya subsequently posted a video of the speech on social media, commenting that the Minister was calling for the "genocide of 80% of the population" who follow the faith.

A complaint was lodged by a DMK functionary in Trichy, leading to an FIR against Malviya under Sections 153, 153A, and 505(1)(b) of the IPC, alleging that he distorted the speech to incite communal disharmony.

Justice S. Srimathy, allowing the petition to quash the FIR, categorically stated that Malviya’s tweet was a defense of his faith, not an act of aggression. The Court noted that Malviya, identifying as a "Sanathani," was effectively a victim of the Minister’s original hate speech.

The Court expressed deep concern over the imbalance in legal action:

"This Court with pain records the prevailing situation that the person who initiates the hate speech are let scot-free, but the persons who reacted for the hate speech are facing the wrath of the law... The Courts are also questioning the persons who reacted but are not putting the law on motion against the person initiated the hate speech."

Going beyond the immediate facts, the Bench took judicial notice of the historical context of political rhetoric in the state. The Court observed a pattern of hostility toward Hinduism by the Dravida Kazhagam (DK) and its offshoots over the last century.

"It is evident that there is a clear attack on Hinduism by the Dravida Kazhagam... for the past 100 years... While considering the overall circumstances, it is seen the petitioner had questioned the hidden meaning of the minister's speech."

The Court concluded that since the Minister's speech itself fell within the "mischief of hate speech" against Hindus, Malviya was entitled to question its intent and potential consequences without facing criminal liability.

This ruling is a significant reinforcement of the right to political criticism and interpretation. By distinguishing between initiating hate speech and reacting to it, the Madras High Court has set a protective precedent for digital expression in heated political debates. It sends a stern message to law enforcement agencies against registering "tit-for-tat" FIRs that penalize critics while ignoring the provocateurs, emphasizing that the context of "who started it" matters in the eyes of the law.
