In a stern reminder of the dignity and respect a woman deserves within a marriage, the Supreme Court of India recently observed that a husband cannot treat his wife like an animal. While hearing an anticipatory bail plea filed by a man accused of brutal domestic violence, the Court emphasized that marital relationships should be based on dignity rather than dominance.

A vacation bench comprising Justice Aravind Kumar and Justice PB Varale was hearing a Special Leave Petition (SLP) filed by one Umesh Ray. The petitioner had approached the top court after his bail application was rejected by the Patna High Court.

The case involves harrowing allegations of physical abuse and domestic cruelty. According to the prosecution, the accused (the husband) frequently returned home in a drunken state and subjected his wife to severe physical violence.

In a specific incident mentioned in the First Information Report (FIR), it was alleged that the husband threw his wife to the ground, where her head struck a brick. Not stopping there, he allegedly proceeded to assault her with a wooden stick (lathi).

Adding a layer of complexity to the case, the prosecution revealed that the accused had allegedly married three times. While the husband disputed his marriage to the complainant, the High Court and subsequently the Supreme Court took note of the prosecution's claim that he had failed to provide even basic maintenance or medical expenses to the victim after the assault.

During the proceedings, the bench expressed its displeasure at the nature of the allegations. Justice PB Varale remarked that there is no justification for treating a wife with such lack of humanity, likening the alleged treatment to that of an animal.

Justice Aravind Kumar was equally vocal, questioning the petitioner’s counsel: "Why do you want to hit your wife, sir? Go for regular bail. You are having three wives, now this girl will also leave you if you are hitting her."

The Court noted that the allegations were serious enough to warrant a full investigation and that granting protection from arrest (anticipatory bail) would not be appropriate in such circumstances.

Sharing a poignant anecdote from his time in legal aid, Justice Aravind Kumar highlighted the deep-rooted patterns of domestic abuse in society. He shared a "small experiment" conducted on cases reported on Saturday nights.

"We found that in one police station, it was always the wife as a complainant... the grievance of the wife was that on Saturdays, they used to get weekly wages, so [the husband] used to drink and hit the wife," Justice Kumar shared. He noted that the pattern of alcohol consumption leading to physical abuse is a recurring theme in many Indian households.

The case was registered under several sections of the Bharatiya Nyaya Sanhita (BNS), the new penal code that replaced the Indian Penal Code (IPC). Specifically, the accused was charged under:

Section 126(2): Wrongful restraint.
Section 115(2): Voluntarily causing hurt.
Section 85: Cruelty by husband or relatives (equivalent to the old Section 498A IPC).
Section 353: Misconduct in public by a drunken person.

The Patna High Court had earlier denied bail, citing the husband’s conduct and the fact that he had allegedly contracted multiple marriages without supporting the complainant.

By refusing to grant anticipatory bail, the Supreme Court has sent a clear message: the sanctuary of marriage does not provide a license for violence. The court’s oral remarks serve as a reminder to the society and the legal fraternity that domestic violence is not just a "private matter" but a violation of human dignity.

The petitioner has now been directed to surrender and apply for regular bail before the trial court, where the merits of the case will be tested through evidence.
