Introduction:-

​Every Indian citizen is entitled to certain basic rights that allow them to live with dignity, freedom, and equality. These rights, known as Fundamental Rights, are given by the Constitution of India. They act as a safeguard against injustice and ensure that no one feels helpless when their freedoms are threatened. Knowing these rights is essential so that every person can stand up for themselves and take proper legal steps if those rights are violated.

​What Are Fundamental Rights?

​Fundamental Rights are the core human freedoms guaranteed to all citizens under Part III (Articles 12–35) of the Indian Constitution. These rights are universal and protect every individual, irrespective of religion, caste, gender, or place of birth. They cannot be taken away easily and are designed to ensure fairness and justice for all.

​The Six Main Fundamental Rights are:-

​Right to Equality (Articles 14-18)

​This right ensures that everyone is treated equally before the law. The government cannot discriminate against any citizen on the basis of religion, race, caste, sex, or place of birth.

​Example Case: Indra Sawhney v. Union of India (1992) – This case clarified the rules related to reservations in government jobs and reinforced the idea of “equality of opportunity.”

​Right to Freedom (Articles 19-22)

​Every citizen has the freedom to express their views, move freely, assemble peacefully, form associations, and choose any profession or occupation. It also guarantees the right to live anywhere in India.

​Example Case: Maneka Gandhi v. Union of India (1978) – The Supreme Court held that the “right to life and personal liberty” means living with dignity, not just mere survival.

​Right Against Exploitation (Articles 23-24)

​No one can be forced to work against their will or in inhuman conditions. This right also prohibits child labour in factories, mines, or hazardous work for children below 14 years of age.

​Example Case: MC Mehta v. State of Tamil Nadu (1996) – The Court prohibited child labour in hazardous industries and emphasized the protection of children from exploitation.

​Right to Freedom of Religion (Articles 25-28)

​Every person has the freedom to follow, practice, and propagate any religion peacefully. India has no official state religion, and all religions are treated equally under the law.

​Example Case: Bijoe Emmanuel v. State of Kerala (1986) – The Court upheld the right of students who refused to sing the national anthem on religious grounds, protecting their freedom of belief.

​Cultural and Educational Rights (Articles 29-30)

​These rights allow minorities to preserve their culture, language, and traditions. They can also establish and manage their own educational institutions.

​Example Case: TMA Pai Foundation v. State of Karnataka (2002) – The Supreme Court clarified that minorities have the right to set up and run their educational institutions independently.

​Right to Constitutional Remedies (Article 32)

​If a person’s fundamental rights are violated, they can directly approach the Supreme Court or High Courts for justice. Dr. B.R. Ambedkar called this right the “heart and soul” of the Constitution.

​Example Case: Kesavananda Bharati v. State of Kerala (1973) – The Court ruled that the basic structure of the Constitution, including fundamental rights, cannot be altered by the Parliament.

​Why Are These Rights Important?

​Fundamental Rights protect citizens from misuse of power and ensure that everyone enjoys equality, justice, and freedom. They help individuals live with self-respect and give them the courage to raise their voice against injustice. Rights like freedom of speech and equality also ensure that the government remains accountable to the people.
