The MADHYA PRADESH HIGH COURT has delivered a significant verdict clarifying the legal position regarding the personal laws of MUSLIM men in INDIA. In a recent judgment, the court observed that a second marriage contracted by a MUSLIM man during the subsistence of his first marriage does not constitute the offense of bigamy under the INDIAN PENAL CODE. The court emphasized that such an act remains governed by personal law, which permits polygamy under specific conditions.
The case originated from a petition filed by a woman who sought to challenge the legality of her husband entering into a second matrimonial alliance. The petitioner argued that the husband had committed the offense of bigamy as defined under Section 494 of the INDIAN PENAL CODE, which penalizes marriage during the lifetime of a spouse. The lower courts had previously dealt with the matter, leading to the case reaching the HIGH COURT for a final interpretation of the intersection between criminal law and SHARIAH law.
Justice GURPAL SINGH AHLUWALIA, while presiding over the matter, referred to the established principles of MUSLIM Personal Law. The court noted that under Islamic law, a man is permitted to have up to four wives simultaneously. Consequently, the court held that the act of contracting a second marriage, provided it is performed according to the rites and ceremonies recognized by the religion, cannot be criminalized under the provisions of the penal code meant for other communities where monogamy is strictly mandated by law.
The HIGH COURT further clarified that the protection offered to a MUSLIM man under his personal law is not absolute in every context but specifically exempts him from the criminal liability of bigamy for a second marriage. However, the court was careful to distinguish between the legality of the marriage under personal law and the potential civil remedies available to the first wife. The first wife maintains her rights to maintenance, dower, and other matrimonial reliefs, which remain unaffected by the husband's decision to marry again.
