In a sharp rebuke to judicial indiscipline, the Supreme Court has stayed the reinstatement of a Madhya Pradesh judicial officer who was terminated for allegedly creating a ruckus, flashing a woman passenger, and urinating in a train compartment while intoxicated.

A Bench comprising Justice Vikram Nath and Justice Sandeep Mehta termed the officer's actions as "disgusting" and "grossest grave misconduct," observing orally that such behavior warrants dismissal, not leniency.

The case involves Navneet Singh Yadav, a Civil Judge (Class-II), who was travelling on a train in 2018. According to the allegations:

He was in a drunken state and verbally abused the Conductor/TTE.
He allegedly flashed a female passenger and urinated on a seat in the open compartment.
He intimidated co-passengers by showing his judicial identity card.
He was travelling without permission from his Controlling Officer and failed to inform the High Court about his subsequent arrest.

Two parallel proceedings were initiated against the judge:

Criminal Case: He was acquitted because key witnesses, including the TTE and the victim, turned hostile.
Departmental Inquiry: The inquiry found him guilty based on the "preponderance of probabilities." The Administrative Committee and the Full Bench of the MP High Court recommended his removal, leading to his termination by the Governor.

However, a Division Bench of the Madhya Pradesh High Court later set aside his termination and ordered his reinstatement. The High Court reasoned that since he was acquitted in the criminal case, he should only face a minor penalty for the procedural lapse of travelling without permission.

The Registrar General of the MP High Court challenged this reinstatement in the Supreme Court.
