Such benefits are independent of the loss suffered due to the accident and therefore do not affect the quantum of compensation payable to the dependents.

    By incorporating the includible allowances into the income calculation, the bench enhanced the monthly income of the deceased MLA from Rs 18,500, as determined by the MACT, to a higher figure that resulted in an increase of over Rs 57 lakh in the total compensation payable to the family. The enhanced amount was directed to be paid by the respondents, Bharti Axa General Insurance Co Ltd and other parties, within the time stipulated by the tribunal.
