A Delhi Court has directed a "monitored investigation" into allegations of sexual harassment against senior officials of Hero Future Energies. The court’s intervention follows a petition filed by a former employee who alleged that the internal handling of her complaints was inadequate and that the police had failed to conduct a thorough initial probe.
The Magistrate observed that in cases involving allegations of sexual harassment at the workplace, it is imperative that the investigation is conducted with extreme sensitivity and without any external influence. By ordering a monitored probe, the court has ensured that the investigating officer must provide periodic status reports directly to the bench, ensuring transparency and accountability in the collection of evidence.
The complainant had alleged that she faced persistent harassment and that the corporate environment was used to silence her grievances. Her legal team argued that a court-monitored process was necessary to prevent any tampering with digital records and to ensure that witnesses, who may still be employed by the firm, can testify without fear of retaliation.
Counsel for the accused officials denied the allegations, characterizing them as disgruntled attempts to settle professional scores. However, the court maintained that the gravity of the charges warranted a rigorous and supervised inquiry to determine the veracity of the claims.
This direction underscores the judiciary's increasing role in supervising the implementation of the POSH (Prevention of Sexual Harassment) framework when internal corporate mechanisms are accused of bias. The police have been directed to conclude the preliminary stage of the investigation within a stipulated timeframe and present the first progress report at the next hearing.
