The Delhi High Court, presided over by Justice Sachin Datta, has sentenced a United Kingdom‑based man to six months of simple imprisonment after finding him guilty of wilfully disobeying several judicial orders directing the payment of maintenance for the welfare of his minor daughter. The Court held that the father displayed a complete disregard for judicial authority and deliberately avoided complying with the maintenance directives passed by the family court.
In its order, the Bench observed that the respondent had repeatedly failed to honour the maintenance obligations despite being served with multiple notices and court directions. The Court characterised this conduct as a deliberate attempt to evade his legal responsibility towards the child, amounting to contempt of the judicial process.
Justice Sachin Datta emphasized that the father’s conduct demonstrated a blatant disregard for the authority of the Court and undermined the efficacy of maintenance proceedings. The Bench noted that such behaviour could not be tolerated, as it jeopardised the financial security and well‑being of the minor child who was the intended beneficiary of the maintenance orders.
Taking into account the persistent non‑compliance and the transnational nature of the dispute, the Court directed the issuance of an INTERPOL Red Corner Notice against the respondent. The notice is intended to facilitate the location and arrest of the individual in the United Kingdom so that he may be produced before the Indian courts to face the consequences of his default.
The Court further clarified that the sentence of six months simple imprisonment is imposed under the provisions governing wilful disobedience of court orders, and that the imprisonment will run concurrently with any other legal proceedings that may be initiated against the respondent for non‑payment of maintenance.
The Delhi High Court’s decision underscores the judiciary’s willingness to employ international legal mechanisms to enforce domestic maintenance obligations. By securing an INTERPOL Red Corner Notice, the Court aims to ensure that individuals who flee jurisdiction to avoid financial responsibilities cannot evade accountability through mere geographical relocation.
