    Allahabad High Court Holds Absence of DBEO Nominee Does Not Vitiate Selection or Justify Salary Withholding

    The Allahabad High Court has ruled that the failure of the District Basic Education Officer to send a nominee to a selection committee does not invalidate the recruitment process or justify withholding salary from the selected candidate.

    Allahabad High Court Holds Absence of DBEO Nominee Does Not Vitiate Selection or Justify Salary Withholding

    The Allahabad High Court has held that the absence of a nominee or representative of the District Basic Education Officer (DBEO) from a selection committee does not vitiate the selection proceedings conducted under the U.P. Recognized Basic Schools (Junior High Schools) (Recruitment and Conditions of Service of Ministerial Staff and Group D Employees) Rules, 1984. The Court observed that mere non-presence of the DBEO’s nominee, as provided for under Rule 15(5)(ii) of the Rules, does not render the selection invalid in law.
